Certification of translations with the seal of
the translation bureau
Every
translation of documents, certificates, invoices, instruments of incorporation
etc. shall be certified with a seal, because a translation printed on blank
sheets has no legal effect.
We may qualify
such a service as an "official translation" because a translation isn't
certified by a notary but is certified by a seal of a company that has performed
the translation of a document or a text. This means that the translation wasn't
performed by the document owner themselves but by a competent company.
There are
cases when a translation shall not be certified by a notary. There are several
consular services in Kyiv that don't require notarial certification of documents'
translation after imprinting of Apostille stamp. They consider the
certification with the seal of a translation bureau to be sufficient, because
it confirms that the translation is performed by a competent company but not by
the owner themselves.
Another
case when the certification with the seal of a translation bureau is required
is the absence of the original documents. It is required by law that a notary
should certify copies of documents only when the original documents are
present: an original document might be lost, or on delivery (be delivered by
mail, currier service etc.), be kept abroad etc.
There is a
list of documents and texts, the translation of which may not be certified by a
notary.
It includes:
-
translation
of newspaper articles,
-
translation
of documents written by hand,
-
translation
of documents not certified by signatures and seals,
-
translation
of magazines,
-
translation
of advertising booklets,
-
translation
of labels,
-
translation
of manuals,
-
translation
of foreign documents issued by state institutions and not having an Apostille
stamp,
-
translation
of filled forms,
-
etc.
In these
cases translations are certified with the translation bureau seal.
It is
possible to print the translation and impress a stamp containing a certifying
inscription under it and affix the seal of a translation bureau, or a
translation containing several pages might be filed to a copy of the document
or the text and certified overleaf.
How exactly
is it performed?
A
translation is printed, than filed to a copy of the document in the same way as
for notarial certification, and certified overleaf with the seal of the
translation bureau.
The
certification by the translation bureau as well as the certification by a
notary is performed in the state language.
