Notarial
certification of authenticity of translation is included in the list of
notarial actions.
Notarial actions are legally relevant actions performed by
notaries, public officers of local executive
power agencies, and also by authorized officials of consular institutions.
A notary (Latin notarius -- a clerk, a secretary) is a lawyer specially
authorized to perform notarial actions including certification of authenticity
of documents copies and extracts from them, certification of authenticity of signatures
on documents, certification of authenticity of documents translation, and some
other actions that differ throughout the world.
Why it is
required to certify a translation by the notary?
After being
translated, many documents are submitted to the Ministry of Justice and
consular services. For confirmation that
the translation was executed by a competent person and not by its owner
themselves, the notaries were authorized to certify the authenticity of
documents translation.
It is specified
in the article 79 «Certification of authenticity of translation» Law of Ukraine
«On Notariate» (Verkhovna Rada Bulletin (SVR), 1993, № 39, page 383).
A notary
certifies the authenticity of a translation of a document from one language
into another if he or she knows that certain language. If a notary
doesn't know a certain language, then a document's translation might be
performed by a translator, the authenticity of whose signature is certified by
the notary.
All
notarial actions including certification of the authenticity of a document's
translation are performed by the notary in the state language and, accordingly,
in our country they are performed in Ukrainian language. Form N

Practically
by certification of the authenticity of a document's translation a notary
usually has to employ the services of a qualified translator, because notaries
seldom know a foreign language on a level sufficient for this purpose. Consequently,
to certify the authenticity of the translator's signature, the notary should
confirm his/her identity. Thereby the translator in addition to a document
confirming their identity produces a document certifying their qualification. If
a notarial office has a filed authorized signature of the translator and their personality
is known to the notary, then by the next certification of the translator's
signature the notary confirms only the identity of a person who has submitted a
document for certification of its translation.
Usually notaries don't
employ the translators' services directly for the lack of time. For translation
the specialized translation bureaus exist that perform the translation of the
documents that are later certified by a notary. For certification it is
obligatory to produce to the notary the original documents.
Some of our
Clients, being not aware of the procedure of document's translation
certification, ask for what purpose do they have to leave the original
documents in the office of a translation bureau,
because a
notary certifies the translation only. The reason is that the notary has no
right to certify a copy if the original document isn't present; it is specified
in the abovementioned article of law.
Besides, a
translation includes the whole text of a document, including seals and stamps.
While comparing the translation with the original document, a notary checks
whether the translation is complete.
Most often
a translation is performed on a separate sheet or sheets. It is attached to the
original document, laced and ratified by the signature of a notary and their
seal.
Such procedure is effective for the documents issued for temporary use:
certificates from the place of employment, certificates from the place of
residence, certificates of good conduct, medical certificates, notarial
applications for leaving abroad, powers of attorney, notarial copies of
certificates and all documents issued in foreign countries.
The documents of permanent effectiveness are not laced to the
translation. They are copied. These are all documents issued in registry offices
(birth certificates, marriage certificates etc.), educational documents (diplomas
and enclosures to them, school certificates etc. and enclosures to them, etc.),
statutory documents of enterprises (statutes, registration certificates,
licenses etc.) and other.
If a Client
needs to submit the translation of a document to several institutions, then the
notary along with the certification of authenticity of a translation or
authenticity of a translator's signature may certify the authenticity of a copy
of a document with the translation.
